When you have an idea and you have the Strong Belief that your findings represents
an Invention with the potential for a Patent the very first thing you have to consider is:

Be aware of older methods of protecting an invention which are not accepted anymore.

= Sending a letter to yourself containing your patent material. (A common method  used
    by musicians to protect their compositions)

= Having your invention material notarized.

= Do not have other people sign and date your material as witnesses.

= Filing a Disclosure Document with the US Patent Office is not possible anymore.

    Effective February 1, 2007, the Disclosure Document Program, protecting an inventor

    for 2 years has been eliminated by law.

Once your invention is placed with an patent attorney, Legalzoom or me who  assure Strict

Confidentiality you are protected against disclosure to third parties. However, if somebody
anywhere in the world would apply for a patent which is identical to yours this person

will own the rights. In other words who files first owns the idea. First filing is the rule to

prevent long and costly lawsuits.

Explore your Idea to make sure your Invention qualifies for a patent. (For example a invention

doesn’t qualify if it is already to a far extend common knowledge or used.)

This determination of qualification can be achieved by searching several achieves using

any search word which comes to your mind even it is not directly related to your Invention.

= Create a Journal which should contain Sketches, Descriptions and Test Data (if available)
    and keep it in a safe place. This helps you to present, in a comprehensive way, your

    invention to an Patent Attorney or to me for Engineering and Invention Development which

    will have several advantages for you:

= Calculate how much the protection of your invention will cost you. What realistic return,

    within a certain time frame, determined by you, is expected.

= Make a market research study. Look at potential competition.

= When you come to the conclusion, after your search, that you have an Invention that

    promises financial return and hasn’t revealed any substantial prior art, the next step is

    that you protect your idea.

   You have three Options:

    (A)

         Note: Using a registered Patent Attorney is the best way. However, for a private

                 inventor the cost may be out of reach (The patent application cost on average

              from start to finish can go up to $30,000.00 or more.
              (One of our customers just lost a large sum of money by not obtaining confirmation
              that the attorney he used was registered with the US Patent Office.) < Scam
       Make sure that the patent attorney you choose is registered and here is the best

   (B)

s     = The second option is to apply for a Provisional Patent which is valid for one year and
      gives you full protection. Using this method allows you to legally use the term
 

                                                  “Patent Pending”.

 

   = My advice is to decide in favor for a Provisional Patent, which is a low cost approach

      and gives you time to market your invention by selling the idea, granting Licenses or
      starting your own manufacturing business.
     = I recommend for a Provisional Patent filing with Legalzoom:  
       (Even they are being criticized on the Internet)
    
   = When you enter the web site go to “Patents” and you will find a lot of information.
   = Legalzoom has created a very simple example of how a Provisional Patent should look.
      Study the sequence of the application and drawings which will make it easier for
       you to file with Legalzoom.

   (C)

      Anybody can file a patent directly with the US Patent Office.
      However, you have to know the laws and regulations thoroughly otherwise your application
      will be turned down.
